The judicial system is improving in line with modern challenges

On September 24, the Ministry of Justice and the Committee on Legal Policy and State Building of the Milli Majlis held a public presentation on “Development of the judicial system under the leadership of President Ilham Aliyev: challenges, reforms and innovations” at the Sumgayit Judicial Complex. The event was attended by Deputy Justice Minister Togrul Musayev, First Deputy Speaker, Chairman of the Committee on Legal Policy and State Building Ali Huseynli, Chairman of the Parliamentary Committee on Human Rights Zahid Oruj, MPs, Chairman of the Bar Anar Bagirov and officials of the Ministry of Justice.

It was also reported that a special portal on municipalities has been developed to increase the efficiency of municipal activities and ensure citizens’ access to municipalities. At the same time, the efficiency of work in this area has increased significantly, with the organization of direct payments to bank accounts for the smooth execution of court decisions on taxes, insurance, alimony and other debts. The integration of the e-court information system into the prosecutor’s office has made the administration of justice more efficient and flexible.

In support of the successful social policy of the President and First Vice President Mehriban Aliyeva, the relevant power of attorney was issued free of charge to orphans provided with free medicines by the state.

When there is a need for notarial services in banks, it is possible to immediately formalize these actions on the spot via video link. The same services are also provided in the “DOST” centers of great social significance, initiated by First Vice President Mehriban Aliyeva. It has been improved in the “Mobile Notary” and it has become possible to register the power of attorney issued to a lawyer for representation in court by telephone without going to the notary.

Deputy Justice Minister Togrul Musayev stressed that the event served to develop effective cooperation and strengthen mutual trust between the legislative, executive and judicial authorities. He said that our state, people and heroic army have won a glorious victory in the Great Patriotic War under the leadership of President of the Republic of Azerbaijan, Supreme Commander-in-Chief Ilham Aliyev. Thanks to this victory, Azerbaijan has restored its territorial integrity, our lands have been liberated from Armenian occupation and new realities have emerged in the region. In his annual speech at the 76th session of the UN General Assembly, the head of state once again conveyed the truth to the world community.

It was noted that today our country, having experienced its most powerful period, has entered a very important and responsible stage in its history. In the territories liberated by the political will of our President, multifaceted landscaping work is already underway. Important social projects are being implemented on the noble initiatives of First Vice President Mehriban Aliyeva. Emphasizing the importance of ensuring the rule of law and judicial reform in the socio-economic development of Azerbaijan, the Deputy Minister noted that the Presidential Decree “On deepening reforms in the judicial system” dated April 3, 2019 is an important “road map” in this area. He noted that reforms are being carried out in accordance with the challenges. It was also noted that increasing transparency in the judicial system is one of the national priorities of Azerbaijan for socio-economic development until 2030, and the ministry is working in this direction.

T.Musayev noted that Sumgayit Judicial Complex was commissioned this month with the participation of the President, and a new building of Surakhani District Court was commissioned in May this year, as well as a virtual presentation of the Judicial Complex built in Masalli district during the opening ceremony. He stressed that this is an indicator of the state’s special care for law, justice and democratic development. It was reported that over the past 17 years, a total of 35 courts, as well as new, modern buildings and complexes for the judiciary and the judiciary have been built and commissioned in the capital and regions at the expense of the state budget and with the participation of the World Bank.

Ali Huseynli, First Deputy Speaker of the Milli Majlis, Chairman of the Committee on Legal Policy and State Building, shared his impressions of the modern building of the Sumgayit Judicial Complex, emphasizing that the complex was built in accordance with the high status of the judiciary. He said that there are effective relations between the three branches of government. The Parliamentary Committee on Legal Policy and State Building closely cooperates with the judicial system and contributes to the discussion and adoption of new bills.

The chairman of the committee said that he was also represented in the parliament and the Judicial-Legal Council and participated in the implementation of judicial and legal reforms in the country. He noted that the decree signed by the President in 2019 marked a new stage of reforms in this area, emphasizing the importance of raising awareness about the measures taken.

The event featured speeches by senior officials of the Ministry of Justice and the Judicial-Legal Council on reforms in the judicial system, including measures taken to strengthen the independence of the judiciary, increase the efficiency of enforcement of court decisions and innovations.

It was noted that in accordance with the instructions of the President, reforms in the judicial system are being successfully continued. As part of the implementation of the Decree of the President of Azerbaijan dated April 3, 2019, the study of international best practices in the organization of commercial courts, humanization of penal policy, decriminalization of crimes, improvement of enforcement of judicial decisions and forensic science, formation of a unified judicial practice and other issues. Numerous draft normative acts have been developed taking into account their opinions, and many new laws have been adopted by the Milli Majlis on the legislative initiative of the President.

In the current year, measures are being taken in this area, the application of rules of procedure for small claims (simplified proceedings), terms of consideration of lawsuits, as well as the maximum number and special cases of postponement of court proceedings, the submission of certain documents on paper It was noted that new draft laws have already been adopted. It was also noted that in order to reduce the workload of courts and ensure better quality of cases, the decree allocated 200 additional judges and took consistent measures to staff the judiciary with highly trained, innovative and moral lawyers. It was noted that the successful results of the reforms are also evident in court statistics. Thus, the stability of court decisions in civil and commercial cases reaches 95-96 percent. Approximately 5-6 percent of plaintiffs or defendants appeal to the Supreme Court of Cassation. These results are a clear demonstration of the growing trust and public confidence in the courts.

The speeches informed about the measures taken to increase the efficiency of the execution of court decisions and alternative punishments, which are an integral part of justice and are binding. It was noted that due to the heavy workload of the ministry’s executive service, effective measures are being taken to improve the implementation of decisions, legislation is constantly being improved, as well as for the first time a draft Executive Code has been developed to systematize regulations in the executive branch. As a result of effective measures taken in this area, there is an increase in the number of executed works.

At the same time, the effectiveness of alternative punishments to imprisonment has been increased. The use of electronic means of control has been expanded in order to effectively monitor the execution of these sentences. At present, about 4,200 prisoners carry electronic wristbands and are subject to non-return probation.

Other MPs and heads of civil society institutions praised the measures taken in the judicial system, the modernization of judicial infrastructure, the widespread use of digital innovations in the field of justice and the judiciary, and stressed the importance of introducing innovations in this area to the general public. .

In their speeches, they also shared their views on strengthening the independence and prestige of judges, increasing public confidence in the courts, ensuring the fairness and enforcement of court decisions, greater use of electronic systems by citizens and other issues, and made specific proposals.
