Baku:Azerbaijan is set to prohibit the replacement of the minimum period of annual leave with financial compensation, as per a proposed amendment to the Labor Code.
According to Azeri-Press news agency, the draft amendment suggests that the minimum annual leave of 21 calendar days, as established under Article 114.2 of the Labor Code, should not be substituted with financial compensation. The only exception would be the scenario outlined in Article 144.2, which permits compensation upon termination of employment.
Additionally, the proposed amendment aims to clarify the conditions under which annual leave can be postponed. It details a comprehensive framework for postponing leave, ensuring that the circumstances are clearly defined. Furthermore, the draft law includes plans to revise other sector-specific laws related to this right, ensuring consistency across the legislative framework.
