Baku: Azerbaijan has formalized procedures for allowing flights to continue after aircraft landings due to flight regulation violations. This development is encapsulated in the newly approved “Rules for permitting the continuation of a flight after landing an aircraft violating flight regulations and clarifying the causes of the violation,” which has been sanctioned by the Cabinet of Ministers under Article 8.1 of the Law of the Republic of Azerbaijan “On Aviation.”

According to Azeri-Press News Agency, the decision outlines that any aircraft crossing Azerbaijan’s state border without necessary permits or violating flight regulations may be forcibly landed upon request by the Ministry of Defense of the Republic of Azerbaijan. This action is in compliance with Article 56.5 of the Law governing aviation activities within the nation.

Upon the aircraft’s landing, the Ministry of Defense is tasked with promptly notifying the permanent commission responsible for probing aviation incidents and accidents, as directed by Article 17.1 of the Law. The investigation into the causes of the violations, as specified in Clause 2.1 of the Rules, must be completed by the commission within a 15-business-day timeframe.

In instances where elements of a criminal offense, as defined by the Criminal Code of the Republic of Azerbaijan, are detected in relation to the violation, the collected documentation is forwarded to the appropriate law enforcement agency for further action.
