Court did not accept activist’s claim against the President of the country

The Sabail district court of Baku refused to consider a claim of public activist Bakhtiar Hajiyev against Azerbaijani President Ilham Aliyev. This was stated by the activist himself.

It should be recalled that Hajiyev appealed to the court beliving it a violation that his Facebook account was blocked by the official page of Ilham Aliyev following which he is unable to submit his comments under the President’s posts.

Note that judge Shahin Abdullayev explained his decision as being due to the fact that Hajiyev himself believes that the official page of the head of state is run by the Presidential Administration. Hence, the President cannot be identified as a defendant, the judge said, since the plaintiff himself considers other persons to be this page’s administrator.

Hajiyev considered the judge’s arguments unfounded and appealed to the court again. Now he asks to involve both the President and the Presidential Administration as defendants.

It has to be kept in mind that Hajiyev believes that the blocking his account on the President’s page is a violation of the Constitution and the European Convention of Human Rights which guarantee freedom of expression
