Accra:A draft Civil Service Code has been prepared and was submitted for discussion at a meeting of the Milli Majlis. This new code consists of 15 chapters and 94 articles and aims to repeal six existing laws from the date it comes into force.
According to Azeri-Press news agency, the laws to be repealed include the Law "On Civil Service," the Law "On Reduced Working Hours for Certain Categories of Civil Servants," and the Law "On Approval of the Regulations on the Civil Service Management Council of the Republic of Azerbaijan." Additional laws include those establishing local and increased coefficients for the position salaries of civil servants and the Law "On Rules of Ethical Conduct of Civil Servants."
Pending the full implementation of the new code, other normative legal acts will remain applicable as long as they do not contradict the new regulations. The new code will also allow individuals holding a valid "Civil Service Certificate" to participate in interviews during the validity of their certificates.
The Civil Service Code will regulate the general rules and conditions of service in state bodies and manage relations concerning the legal status of civil servants within the civilian branch. It will exclude the President, Vice-Presidents, MPs, Prime Minister, judges, and specific high-ranking officials, whose employment relations will continue to be governed by other laws.
Additionally, the code will not apply to employees of subordinate institutions that are not part of state body structures, as their employment relations are regulated by the Labor Code. The draft law has been voted on and adopted in the third reading.
