Azerbaijan Prohibits Child Abusers from Acting as Legal Representatives in Civil and Criminal Cases

Baku: Azerbaijan has introduced a significant legal amendment that bans individuals accused of inflicting harm on others from serving as legal representatives in both civil and criminal proceedings. A new draft law, titled 'On the Rights of the Child,' was discussed during a session of the Milli Majlis Committee on Family, Women and Children's Affairs, highlighting this crucial change.

According to Azeri-Press News Agency, the proposed amendment specifically targets individuals alleged to have caused moral, physical, or material damage to a victim, civil plaintiff, suspect, accused person, or civil defendant. Such individuals will be prohibited from participating as legal representatives in related legal proceedings. This initiative aims to safeguard the interests and well-being of the parties involved, particularly children.

Furthermore, to ensure the protection of personal data of children involved in criminal proceedings, the amendment to the Criminal Procedure Code mandates that consent for disclosing information about the identity of minor suspects, accused persons, or victims must be provided in written form only. This consent is required from both the children and their legal representatives, ensuring a secure process for handling sensitive information. A similar approach is being proposed for the Law "On Media," emphasizing the importance of privacy and protection for minors in legal contexts.
