Azerbaijan Sets Liability Limits for Baggage Damage in Air Transportation


Baku: The limit of liability for damage to baggage and cargo in air transportation has been determined in Azerbaijan, APA reports. This is reflected in the “Rules for the implementation of commercial air transportation, air transportation of passengers, baggage, cargo, and postal items” approved by the Cabinet of Ministers.



According to Azeri-Press News Agency, the procedure for calculating and paying compensation for damage to passengers, baggage, and cargo related to air transportation has been established. The limit of liability of carriers for baggage or cargo registered without declaring its value, accepted for transportation by carriers belonging to the Republic of Azerbaijan in domestic transportation, has also been determined.



The decision specifies that the liability and extent of the carrier’s responsibility for damage to the life or health of an aircraft passenger, as well as to their property, are governed by the Civil Code, the Criminal Code, and international treaties to which Azerbaijan is a party. The carrier is responsible under the legislation for any damage to the life and health of passengers during boarding or disembarking from the aircraft.



Furthermore, the carrier is not liable for the death or deterioration of a passenger’s health resulting from any pre-existing illnesses. However, the carrier is liable for the loss, shortage, or damage to baggage and cargo up to their actual value, not exceeding the limits set by the regulatory legal acts specified in these rules and international treaties.



Compensation for the loss, shortage, or damage of baggage and cargo will be paid as follows: for baggage and cargo with declared value accepted for air carriage, the compensation will be equal to the declared value; for those with undeclared value, compensation will be limited to the amount of the special borrowing right established by the Montreal Convention of May 28, 1999.
