The tender commission of Baku Metro today announced the cancellation of the results of the procurement tender for purchase of sandwich panels (1,350 m2), polymer-coated corrugated board (6,662 m2) and fibre cement sheets (250 pieces). The Public Procurement Regulatory Authority confirmed the bias of the tender commission on the appeal of the participants in this procurement. The tender procedure https://etender.gov.az/main/competition/detail/294231 was held on 22 September this year, and already on 4 October the State Service for Antimonopoly Supervision and Consumer Market Control issued its verdict on the basis of Article 38, paragraph 2 of the Law of the Republic of Azerbaijan “On Public Procurement”. This paragraph regulates the legal aspects of conflict situations, when one or more participants of a competitive procurement procedure consider that the tender commission is not objective and is on the side of a certain participant. There is no information on the results of this e-tender in the public procurement portal. No names of its participants are known either. It ought to be noted that recently the intensity of complaints against the tender commissions from the participants of public procurement tenders to the supervisory authority has intensified and more and more often the tender commissions are found to be biased. Whether their behaviour is an indicator of corruption is unknown, as there is no information about referral of cases on the results of investigations of the Antimonopoly Service to law enforcement bodies.
