Baku: The right of debtors to leave Azerbaijan will be temporarily restricted under new regulations, as reported by APA. This amendment to the ‘Law on Execution’ has been signed into effect by President Ilham Aliyev through a presidential decree.
According to Azeri-Press News Agency, the new law stipulates that if execution documents are not voluntarily executed by the debtor, whether an individual or the head of the executive body of a debtor legal entity, within the designated time frame and without valid reasons, their right to leave the country may be temporarily restricted. This restriction would be enforced through a court decision based on a substantiated presentation by the enforcement officer.
The role of electronic systems is to be significantly increased under these amendments. Court decisions regarding the temporary restriction of a debtor’s right to leave the country will be immediately transferred from the Electronic Court Information System to the Electronic Enforcement Information System.
Furthermore, the “Electronic Enforcement” system will facilitate the immediate transmission of this information to the “Entry-Exit and Registration” inter-agency automated data search system, where the necessary restrictions will be applied to the debtor individual or the head of the debtor legal entity.
Debtors and creditors will be informed through the “Electronic Enforcement” system. Notifications will include SMS updates sent to the registered mobile phone numbers of the debtor individual or the head of the debtor legal entity.
Once the reasons for the temporary restriction are resolved, the information will be updated in the ‘Electronic Enforcement’ information system and transferred to the ‘Entry-Exit and Registration’ system. Subsequently, the restriction will be lifted, and an SMS notification will be sent to the debtor’s mobile phone number regarding the removal of the restriction.
